    Nowadays the number of baby dumping cases has become serious issue and it has become one of the main topics to be discussed. This baby dumping issue always related to youth nowadays. This situation must be stopped by society, if not many life will be victim to this irresponsible people. We must know how it can happens, the effects and how to prevent it.

       Firstly, baby dumping can happen if people or society lack of education. For youth, they need to be educating at school. They must get formal education at school. While, at home they are getting informal education about the negative effect of baby dumping informally from their parents. As a Muslim, they need to aware that baby dumping is forbidden. They need to think it wills worth them nothing.

        Secondly, according to Hon Diende (2007), this issue can be avoided if youth control their social life. Youth nowadays is more social than before. Before this, parents control all their children activities including their children social life but nowadays parents are different, they trust their children can manage their life wisely. Parents should care about their children activities and friends. Parents must know what their children doing and with whom their children are friend with.

           Baby dumping have many negative effects, one of the effects is it will cause uncomfortable situation to their family. This is because people will always think badly about people that have done wrong doing such as baby dumping. Their family will face all the critics from society.  Society will lose respect to the family involved. According to Dianne Habbarb (2008), they may feel shame having giving birth outside of marriage.  It makes their family feel very embarrassed to face the society.
On the same token, it will cause health effect. It can happen because while they want to give birth to their child, usually nobody knows about that, so, there is no expert to help them to give birth to their child. Their child will not properly birth. They might give birth to their child at unsuitable place because they are shame people may know that they give a birth to an illegitimate child.

       On psychology side, youth that having this situation might live in depression. They might face a lot of outside pressure. For example from their family themselves, for family that have daughter that pregnant an illegitimate child, their family might forced them to have abortion. If they keep going receive pressure from their family, it might cause their children to commit suicide.
     
      This problem will affect their studies. They have to stop their studies because of their pregnancy. If their pregnant reach up to 4 or 5 month, there will some changes to their physical such as their body will getting bigger than before and bring many problem to them. Their friends will ask a lot of question because of their physical changes. So, one of the ways to avoid this situation is by quit their studies.
   
     There is suggestion on how to prevent this baby dumping from happen such as educate youth from at an early stage. They must be informed and educate about this start from secondary school until their further their education to university. The Ministry of Education must create special syllabus to overcome this problem. While at home, according to Hun Nujoma (2007), parents to be educated about their role in bringing up of their children. Single mothers need to continue give more love to their children and have open discussion at home.

       Besides that they are involved in baby dumping need to give heavy punishment. Government need to give lesson that make them regret. The government must give them a heavy punishment to them. For example, let them doing community service or canning them. God willing they will realize.
     
       As a conclusion, youth nowadays need to realize that baby dumping is alarming issue that can cause them a lot of trouble. They need to be educated on how it happens can happen to them and how it can affect their live if they involved in this issue. Then, they should be educating on how to prevent it.

Meaning
-Dumping baby means that the acts of throw away the babies at any places without take care the babies.
Star online-Anyone who dumps a baby causing the child to die can be tried for murder and sentenced to death, the Cabinet has decided. It has agreed to the proposal by the Women, Family and Community Development Ministry over the issue because incidents of baby dumping were still rampant in the country, minister Datuk Seri Shahrizat Abdul Jalil said.

Cause-
-Parents- abondoning responsibilities-result= their son's cannot differentiate between good or

proven its worth in terms of socialization and communication
-Unwanted Pragnancy-when unwed girls find themselves pregnant,afraid to tell their parentsabout unwanted pregnant and their don’t know what to do, so the best thing in their mind isthrow out their baby’s without feel guilty

Effect-
There are three effects of Baby dumping.on individuals, the Baby and society. Individuals- cause
by illegal way of aborting the child and left a bad effect on them because of the wrong path, they use to abort the baby just like herbs and alcoholic substances. So, the individual will have high risk of death caused by bleeding and infection on mothers womb's. Another way is dangerous and is not clean by inserting foreign objects into the womb. Women involved who do abortion without proper medical procedures take high risks facing death following infection and bleeding in the uterus. In addition, it is potentially experiencing bleeding in the stomach which can cause the woman unconscious or worse death. Womb also suffered injuries when doing an abortion because those who perform them are traditionally not qualified will use sharp objects such as wood, twigs or wooden sticks. Bleeding sometimes can not be detected quickly, but take a long time. There are not aware of them until they bleed unconscious.. Otherwise, the effects of abortion also can cause psychological effects on the mental and emotions after marriage, especially depression, especially when age is often thought of as the content is never removed. Dysphonic effects include experience in the womb, which raised pain more than experience during the menstrual process.

Introduction
I’m proud to be a Malaysian but what happened recently make me thinking….?? Our country, Malaysia has become the most favorite spot for dumping babies. The year 2010 is also known as Baby Dumping cases for Malaysia which brings a lot of questions and issues. Baby dumping is a social crisis and has a chronic increase as many cases are occurring in Malaysia country. We have heard about fruit season, fever season but this is the first baby dumping season in Malaysia. New Year celebration and Valentine’s Day known as ‘mating season’ nowadays   leads to unwanted pregnancies among youths. Child is a priceless gift from God but the youths still carry on their activity for their enjoyment. The news are so horrifying such as ‘Body of baby found in dustbin’, ‘Dead baby found in casino trash bin’ and ‘Dogs found baby in bag’. This scenarioad been more serious from day to day although there are a lot about this in the mass media. The baby is not guilty. Why are they punished in such a way because of their own unknown parent’s mistakes? How the teenagers can throw their own baby in such a horrified situation? Don’t they think at least once before they did their action? Is sex is very important for them until they can forget the world? Or they are lack of sex education? What is the use of condoms? Where did they learn to cover their mistakes? Is this their religious teach them? What are the best opinions and ways that should be taken to prevent this scenario from spreading? Is this scenario will continue without ending? Who should we blame - the parents of teenagers, media, teenagers, school, government or friends? Questions by questions coming over but no solution until now.

Causes of baby dumping
      We can point our finger to anyone we want but this time we have to examine this social problem obviously. In my opinion, I think the lives of teenagers are too free without parent’s control.You can look what among of student did in campus or college. Some of them make a date try to do something as couple. Sometimes they make something further. Perhaps that “something” I shall call it as sumbang mahram. Every boy and girl has to know their limitation of relationship. Of course you can be friend with anyone but do not go too far when you be friend with the different gender. Islam teaches us about the relationship in Islam. Now, the girl must not wear the sexy clothes not because of order of people but this  order of Allah. We must follow Allah’s command and what had been written in Koran. Sexy girl dressing is one of cause why the banned relation could happen. It cans rise up the boys ‘desire and passions. That is why social problem could happen.


       The problems usually follow the flow, first is illegal racing, commonly it being held at night, and of course it gives troubles to other road users. Apart from that, it also can be deadly for that person. After having a race, usually they will headed to children activities including their children social life but nowadays parents are different, they trust their children can manage their life wisely. This is the place where they start to take drugs and become addicted to alcohol.        High school students are too immature to fully understand the effects of free sex could have on their lives. So there is no doubt that another problem will be created because of that. For sure the problem is abortion and baby dumping. Panic of being pregnant unexpectedly, they take a risk to abort the baby before their family aware of the physical changes later on. Abortion is a risky action which can be fatal to the mother. But being in desperate situation like this, they cannot think rationally anymore. But not all of them are having enough gut to take the risk for abortion. Some of them decided to give birth to the baby, but then at the end of it, because of some reasons, they dump the baby without hesitate. Dump the baby means that they throw away the babies at any places without taking care of it later. Usually the babies were dump just after they were born. In most of the cases, the babies were already dead when they were found by someone else.
          Sometimes, parents don’t give full attention to their children as today many parents are expect their children are good enough. Parents are also too busy with their jobs until they forget to give attention to their children. This is a serious problem among parents as they don’t know what their children are doing. According to Dr. Khaidzir Ismail, Psychologists of children and adolescents from University of Kebangsaan Malaysia, 2007, “Conflict in the family kicked out of youth to find a place and friends can help overcome life and at the same time meet the needs of finance, entertainment and emotional development”. If someone has poor parental modeling but still goes on to make fantastic life choices, in the same time, they not get attention from family; so very easy to son and daughter involved with social problem like baby dumping.
The first reason is teenagers are lacking of sex education. Parents and schools do not inject sex education onto teenagers' mind since they were small. Parents always think that their children will understand everything about sex when they grow up. This is the natural ability that everybody has and they no need to talk to their children about sex. Most of the parents feel ashamed and uncomfortable everytime their children ask them questions about sex.They refuse to give a positive explanation and a clear view to their children and always claim that they are too small to know about sex. The same thing also happens in schools at where schools do not have sex education as one of their compulsory courses. Most of the schools also never hold any activity about sex education such as talks.They remain quiet and proclaim that these small children will get to know what is sex when they grow up.But, children still gain nothing when they grow up. They do not understand their bodies and some of them may not know what is the differences between boys and girls.Due to the lack of these basic knowledge, surely they do not know how and where a baby comes. So they start to involve with a sexual problem that brought to baby dumping.

Murder : Baby - Dumping An Attempt To Murder

It has been a major issue in Malaysia now where cases of dumping-baby was becoming so serious. Even the Malaysian government has taken severe step to punish the mothers who dump their babies with murder. It might be good start and fresh step to prevent the incidents from happening again.
But to implementing the law and step to charge the murderer will not be easier because an element of intent was required and it was difficult to prove.

PETALING JAYA: Shelter Home executive director James Nayagam said it would be difficult for police to charge mothers who dump their babies with murder because an element of intent was required and it was difficult to prove.


The mother might say that she left the baby to be picked up by people and not with the intent of killing the child, he said.

“It’s difficult to prove murder. We have to prove that there is intent but when a foetus is aborted at three or four months, there is no chance for the baby to survive and hence, no killing is involved,” he said.

Currently, the law does not provide for a person who aborts a foetus to be charged for murder, he told The Star yesterday.

“The concern with charging mothers who dump their babies is that it might lead to more illegal abortions,” he said.

A woman might fear being charged with murder if she intends to abandon her baby and might instead resort to illegal abortion, said Nayagam.

“Even now, it is estimated that about 300 abortions are performed daily,” said Nayagam adding that he had come across a case in the eighth month of pregnancy.

Ultimately, education is the key, he added.

In KOTA BARU, Kelantan Mentri Besar Datuk Nik Abdul Aziz Nik Mat said he welcomed the capital punishment proposal.

The PAS spiritual adviser said such punishment was in line with the teachings of Islam that forbids such heinous acts.

“I agree with the severe punishment proposed for dumping babies,” he said in response to the Government’s proposal to punish offenders with the death sentence.

The Cabinet had agreed to a proposal by the Women, Family and Community Development Ministry that those who abandoned babies resulting in death, should be investigated under Section 302 of the Penal Code for murder.

KUALA LUMPUR: The cabinet has asked the police to probe into baby dumping as attempted murder or murder cases, Datuk Seri Shahrizat Jalil said yesterday.

She said the cabinet agreed that the government should take sterner action to stop baby dumping.

“The government has no choice because of the rising number of cases. Despite the various initiatives, baby dumping is still happening.”

The women, family and community development minister said not only the women involved in baby dumping would be brought to justice, the men, too, would be prosecuted.

“We have taken a welfare approach all this while but the problem continues.

“The government cannot allow this state of affairs to continue and that is why the classification will be changed to attempted murder or murder.”

Under the move, Shahrizat said police, acting on the ministry’s request, would start classifying investigations as attempted murder, or if found with intent, murder.

Police have recorded 60 baby-dumping cases so far this year, compared with 79 for the whole of last year.

Tougher measures, she said, were required as baby dumping could no longer be tolerated.

“Dumping a baby only to see the child found dead in places such as dustbins and toilets is an inhumane act. It is tantamount to murdering an innocent person.”

Shahrizat said she put forward the request to Home Minister Datuk Seri Hishammuddin Hussein during the weekly cabinet meeting on Wednesday.

Police are now investigating baby-dumping cases under the Child Act 2001, and those found guilty, face imprisonment of up to 10 years.

However, those charged under the Penal Code for attempted murder or murder withintent face up to 30 years’ jail or the death sentence, respectively.

Shahrizat said cases involving underage parents would continue to be dealt with under the Child Act but added that it was up to the Juveniles’ Court to decide whether they should be tried as adults.

She said she had also requested for Deoxyribonucleic acid (DNA) profiling to be carried out to ascertain the identity of parents of abandoned babies.

“This is the only way to bring those responsible for the death of a baby to justice,” she said.

Shahrizat said there was no excuse for couples or parents to abandon their babies, given the avenues available for them in seeking help.

She said unwed parents unable to care for their children should approach the various institutions under the ministry or the Welfare Department.

Similar to OrphanCARE, the country’s first baby hatch, the 104 district welfare offices, 60 institutions and 55 clinics set up by the ministry are open to parents to give up their children for adoption.

“They can also approach the police, local hospitals and clinics, even the nearest Umno branch, if they truly need help,” said Shahrizat, who is also Wanita Umno chief.

The ministry had also embarked on an awareness programme at public and private institutions of higher learning nationwide to educate young people, seen as a high-risk group, on the consequences of unprotected sex and the options available for young unwed parents.

She said some of the programmes would be tailored to young males to educate them on their responsibilities as parents and sexual partners.

He said widespread access to porn and weakened family ties have caused an increase in cases since 2005, which numbered 472 as of August 2010. He said more than half the babies in these cases were found dead.
Women’s Aid Organisation executive director Ivy Josiah disagreed with Bakri, saying there was no proven correlation. Rather, the problem was more that women were unable to get their male partners to use contraceptives.

Stop couples from riding the same vehicle together

Mazlan Mohamad, director of the Tengku Ampuan Afzan Teachers’ Training Institute in Kuantan, Pahang, on a circular that prohibits trainee teachers of the opposite sex from riding together on motorbikes or in cars on or outside campus. He did not consider the measure extreme as students had not complained.
He also said teacher trainees frequently left the campus in pairs, and that this might affect the sensitivities of residents in the surrounding community who had a different level of “tolerance” for such things.
Trainees caught would not be punished, however, but given counseling, Mazlan added.

Criminalise baby dumping as an act of murder
“The Cabinet has decided that the Home Ministry through the police, investigate these cases as murder when a baby dies.”
Women, Family and Community Development Minister Datuk Seri Shahrizat Abdul Jalil, on her ministry’s proposal to the cabinet. She said the cabinet agreed that drastic steps had to be taken to stop baby dumping.
Police will be asked to investigate, under Section 302 of the Penal Code, abandoned babies which have died. Under Section 302, the punishment for murder is death. Currently, baby dumping is investigated under other sections or under the Child Act for abandonment, concealment of birth by secret disposal of body, and infanticide, which stipulate jail terms and fines upon conviction.
Reactions to the cabinet decision have been negative, with some saying that capital punishment would not be a deterrent, and that sex education, counselling and support would be more effective. Prime Minister Datuk Seri Najib Razak said not all cases would be classified as murder, depending on police investigations.

Why not stop the stigma — provide baby care, sex education and safe haven laws — instead?
“Criminalising abandonment encourages someone, already in a terrible situation, to make a worse decision to hide a baby.
“The classical fiqh does not try to legislate against promiscuity post facto, knowing that any such activity would harm the baby. In order to save the baby’s life, there can be no criminalisation of abandonment.
“There must be a safe and anonymous way a parent can hand over a baby to the care of someone else.”
International Institute of Advanced Islamic Studies (IAIS) Malaysia principal research fellow DrEric Winkel, on the classical position in Islamic jurisprudence or fiqh, which emphasises saving a baby’s life. Winkel argued that a child was at greater risk if baby dumping was criminalised.
He added that the desire to punish promiscuity must be a separate matter from ensuring the baby’s safety. His article also highlighted a few “baby hatch” programmes which have saved thousands of lives in various countries, including conservative societies. Youths should also be taught to “develop their own filters” to make good decisions and navigate the modern world with all its sexually charged messages, Winkel said.

“Government can consider enacting a law to allow a parent to confidentially surrender a baby to any hospital emergency room or any designated place. The parent should also not be arrested or prosecuted.”
Wanita Gerakan deputy chief Ng Siew Lai, urging the cabinet to consider ways to help unmarried mothers instead of punishing them. Ng noted that the US had such laws in response to the problem of unwanted pregnancies.
She also said the women’s wing disagreed with the cabinet’s decision that baby-dumping cases be investigated as murder. Instead, counselling, rehabilitation, and sex education were better solutions.
